How Artificial Blue Light is Damaging Your Performance


  1. Scope

1.1 These General Terms and Conditions apply to all business relationships between SIIZ  and the customer (the “Customer”) initiated and handled via www.siizhealth.com  online shop. The version of these General Terms and Conditions valid at the time the order is placed will apply.

1.2 If agreements have been entered into separately between SIIZ and the Customer, these General Terms and Conditions will prevail. Unless expressly agreed to in writing by SIIZ, SIIZ hereby refuses to accept any contradicting or other general terms and conditions put forward by the Customer.

1.3 The goods in the online shop are offered to end consumers exclusively. Therefore, SIIZ expressly reserves the right to offer and deliver goods to the Customer in regular quantities only. For the purpose of these General Terms and Conditions (i) “Consumer” means any natural person entering into a purchase agreement for purposes that do not predominantly concern his/her business or self-employed activities, and (ii) “Entrepreneur” means any natural or legal person or legal partnership entering into the contract in the pursuit of his/her/its business or self-employed activities.

1.4 The goods in the online shop currently are offered exclusively to Customers whose habitual residence is located in one of SIIZ’s delivery regions and who can provide a delivery address in one of these regions. Further delivery restrictions are set out under 4. below.

 

  1. Purchase agreement

2.1 Unless the Customer selects PayPal as a payment method, SIIZ’s offerings in the online shop do not represent a legally binding offer to conclude a purchase agreement but rather are an unbinding online catalogue to inform the Customer about the goods offered in the online shop as well as an invitation to place an order. Orders placed by the Customer become binding if the Customer clicks the Buy Now button in the Cart section at the end of the order process. At any time before clicking the Buy Now button the Customer can edit the data entered, change the contents of the cart and/or end the order process by closing the online shop website. By placing an order, the Customer submits to SIIZ a binding offer to enter into a purchase agreement. The order confirmation e-mailed to the Customer by SIIZ does not mean SIIZ has accepted the Customer’s offer to enter into a purchase agreement but serves to inform the Customer that SIIZ has received the order (“Acknowledgment of Receipt”). Unless the Customer has selected advance payment or PayPal as the payment method, the purchase agreement will be concluded when the Customer clicks the Send button. SIIZ will notify the Customer by e-mail when the goods have been entrusted to the provider of logistics services (“Shipment Confirmation”). SIIZ will be entitled, but not obligated, to accept the Customer’s offer to enter into a purchase agreement within 14 days after receipt. If the Customer selected advance payment as the payment method, SIIZ will declare its acceptance of the Customer’s offer by sending the Acknowledgment of Receipt to the Customer. If the Customer selected PayPal as the payment method, the purchase agreement will be concluded when the Customer clicks the Buy Now button.

2.2 In the event the Customer places an order for specific goods which are not available at the time the Customer places the order, SIIZ reserves the right to reject the Customer’s order. Moreover, SIIZ reserves the right to be released from the obligation to deliver goods if the goods ordered are not available after a purchase agreement has been reached. In this case, SIIZ will notify the Customer promptly and will reimburse any money the Customer paid for the cancelled order.

2.3 SIIZ will not accept orders from any Customers who are under 18 years of age at the time the order is placed.

2.4 The language of the purchase agreement will depend on the language offered to the Customer in the online shop. SIIZ reserves the right to provide the Customer with invoices and delivery notes issued in the language of the respective country.

2.5 SIIZ does not save the respective contractual terms and for General Terms and Conditions in such a way that they will be available at any time after the contract has been executed. Only the respective updated contractual terms and General Terms and Conditions will be available.

 

  1. Damaged or faulty glasses

3.1 A Consumer does not have right to cancel an order, however a consumer may exchange an order if the goods they ordered are damaged or soiled when opened within a 30 day period of receiving the goods. Right to exchange orders we will need the following:

  • Picture of the goods they received to show the damage.
  • Proof of date of when items were received. Please provide delivery slip.

Please provide these to siiz@siizhealth.com and we will ship another pair as soon as we receive the damaged goods at no additional cost. We will cover shipment costs too.

 

  1. Delivery, delivery periods, availability of goods

4.1 Deliveries only will be made to the delivery address provided by the Customer and only if such address is located in one of SIIZ’s delivery regions. Details regarding the delivery regions are specified here. SIIZ reserves the right to make reasonable partial deliveries. In this case, SIIZ will inform the Customer in the shipment confirmation.

4.2 As part of the order process, SIIZ will notify the Customer of the delivery period. SIIZ will notify the Customer promptly of any delivery delay resulting from force majeure or other incidents for which SIIZ is not responsible and will provide the Customer with a reasonable new delivery period in line with the circumstances of the delay. In the event the goods cannot be delivered within such new delivery period for reasons for which SIIZ is not responsible, SIIZ can rescind the purchase agreement in whole or in part. In this case, SIIZ will reimburse the Customer promptly for all payments made. If the Customer cannot be expected to accept the delayed delivery, the Customer can rescind the purchase agreement by notifying SIIZ in text form (by letter, fax or e-mail). The Customer’s other statutory rights will remain unaffected.

4.3 The Customer can reserve goods marked as not available in the online shop by clicking on the Reserve button. SIIZ will notify the Customer by e-mail when the goods are available and will provide the Customer with a link to begin the order process.


  1. Prices and shipping costs

5.1 Prices valid at the time orders are placed will apply. All prices include statutory sales tax.

5.2 Delivery costs and all additional costs incurred for services offered by SIIZ in the online shop and requested by the Customer must be specified in the order form and will be assumed by the Customer. Shipping costs may vary depending on the type of delivery and the nature of the order. Details regarding shipping costs are specified here.

 

  1. Payment and payment methods

6.1 SIIZ offers the payment methods that are provided on the website:

Credit card and PayPal.

6.1.2 For credit card payments, SIIZ accepts MasterCard, Visa and American Express. Invoiced amounts will be blocked on the Customer’s credit card on the date the order is placed and will be charged on the date the goods are shipped.

6.1.3 If the Customer selects PayPal, the goods will be shipped subject to the receipt of the payment confirmation by PayPal.

 

 

 

  1. Retention of title

Delivered goods will remain the property of SIIZ until all receivables under purchase agreements have been paid.

 

 

 

  1. Privacy

8.1 All personal data provided by the Customer will be collected, used and processed exclusively in compliance with the applicable privacy laws.

8.2 For the performance of the contract with the Customer it is necessary to process personal data of the Customer. SIIZ processes the contract, order and payment information of the Customer. The legal basis for processing the personal data is the contract between SIIZ and the customer. In accordance with Article 6 para. agreements between SIIZ and the Customer or the Customer’s consent.

  1. Returns & Shipping

9.1 Our return policy for www.siizhealth.com under SIIZ is that an item can be returned within 90 days if that item is in good condition condition. For all prescription glasses, since they are custom made by order they are non-refundable.

9.1.1 Returns and exchanges are for non-prescription frames. Prescription glasses cannot be returned or exchanged because they are custom made.

9.1.2 You must return the item within 30 days of receiving the item with proof of date of receiving.

9.1.3 Item must be in good condition.

9.1.4 Return or exchange shipping cost will be at your own expense.

9.1.5 In case an exchange is to be done because of faulty glasses shipment costs will be handled by SIIZ under the conditions of clause 3.

9.1.6 If you request a refund, it will be credited to the same account as the account from which the original payment was made.

 

9.2 Once you have placed your order you will receive an order confirmation email, this will have your order number listed. Our team will then prepare your order, this will take up to 2-3 business days if Non-Prescription and 5-10 business days if Reading Glasses or Prescription. Once your glasses are ready and have been shipped you will receive a further email to advise.

 

9.2.1 To better serve you we only have one method of shipping on our website and that is fast shipping so we can reach the world in the minimum time.

 

 

  1. Prescription

10.1 For prescription eyewear please note that exchanges and returns are not possible.

10.2 Please allow between 5-10 days for prescription items to be ready and shipped after 2 days from time of order.

10.3 We will provide an area online where you can attach your prescription to us so our optometrist can take a look, however if your prescription information is incomplete, we may need to take additional measurements to better serve you well, which could mean a little longer waiting time for your glasses.

 

 

 

  1. Custom fees

11.1 Customs fees may be charged on the day of delivery depending on your local tax code.

Any applicable duties/VAT are the responsibility of the client, and not SIIZ. We have no control over charging each client additional duties/VAT at the time the purchase is made, and so these fees (if applicable) may be imposed at the time of receiving the package.
